RETURN AND REFUND POLICY

 

 

Damages and problems
Please inspect your order upon receipt and contact us immediately if the item is defective, damaged, or if you have received the wrong item, so that we can assess the problem and remedy it.

 

Article 9. - Right of withdrawal

 

9.1. Returns and refunds

Mahaut Barbier Antiques wishes to offer its Customers the option of returning Items delivered in accordance with the General Terms and Conditions of Sale described below.

9.1.1. Terms and conditions: in accordance with the provisions of Articles L. 221-18 and L. 221-20 of the French Consumer Code. The Customer has a period of 14 days from the date of receipt of their package to exercise their right of withdrawal without having to justify their reasons or pay a penalty, in order to obtain a refund, provided that the Products are returned in their original packaging and in perfect condition within fourteen (14) days of notifying Mahaut Barbier Antiques of the Customer's decision to withdraw.

 

The Customer may return one or all of the Items from their online Order by post.

 

Mahaut Barbier Antiques does not offer the option of returning Products from an Order placed on the Website in a physical store. Any return of an Order placed must be made by post.

Items must be returned complete (including accessories, instructions, etc.) in their original packaging. Items returned incomplete, damaged, or soiled will not be refunded and will be returned to the sender by mail.

 

The shipping costs for the returned package are the responsibility of the Customer.

 

The delivery costs paid when placing the Order on the website will only be refunded if the entire Order is returned.

 

9.1.2. Steps to follow: To return the product(s) ordered, the customer must enclose the withdrawal form (appended as Appendix I to these T&Cs) with their package, along with the invoice for their order, specifying whether they are requesting an exchange or a refund. No returns will be accepted without these two documents.

 

The Customer must complete the withdrawal form included in the package and prepare the package by placing the Item(s) to be returned in the original box.

 

The Customer must return the package using the approved carrier of their choice to the following address:

Once the package has been received by MAHAUT BARBIER ANTIQUES, the Customer will be refunded within 13 days directly to the payment method used at the time of purchase (bank account or PayPal account).

9.1.3. Restriction on the right of withdrawal: in accordance with the provisions of Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for orders of products personalized at the Customer's request, nor for products that are incomplete, modified, damaged, and/or soiled by the Customer.

 

Article 10. – Complaints – Information – Applicable Law – Disputes

 

These General Terms and Conditions of Sale and the transactions arising therefrom are governed by French law.

They are written in French and, in the event that they are translated, only the French text shall be deemed authentic in the event of a dispute.

 

For any information, complaint, or question relating to these General Terms and Conditions of Sale established by Mahaut Barbier Antiques or to the Items themselves, the Customer should contact Mahaut Barbier Antiques by post (49 rue Alexandre Dumas 75011 Paris - France) or by email infos@mahautbarbier-antiques.com  or by telephone: +33 6 29 97 73 19, quoting the reference and date of the Order where applicable.

Any disputes arising from purchase and sale transactions concluded under these General Terms and Conditions of Online Sale, concerning their validity, interpretation, execution, termination, consequences, and repercussions, which cannot be resolved between Mahaut Barbier Antiques and the Customer, shall be submitted to the competent courts under the conditions of ordinary law.

 

The Customer is informed that they may, in any event, resort to conventional mediation or any other alternative dispute resolution procedure.

 

In accordance with the provisions of Article L. 612-1 of the Consumer Code, any consumer dispute or litigation, subject to Article L. 612-2 of the Consumer Code, may be settled amicably through mediation.

 

The Customer may also use the online dispute resolution service offered by the European Commission in accordance with Article 14 of Regulation (EU) No. 524/2013. This platform is accessible at the following address: https://webgate.ec.europa.eu/odr/. Recourse to mediation is an alternative mechanism that does not constitute a prerequisite for taking legal action.

 

Article 11. - Guarantees

 

Products sold on the online store are covered by the legal guarantee of conformity under the conditions set out in Articles L. 217-4 to L. 217-13 of the Consumer Code, as well as the guarantee against hidden defects as defined in Articles 1641 to 1649 of the Civil Code.

In the event of non-compliant or defective product(s), customers may return them under the conditions set out above, provided they have first contacted Mahaut Barbier Antiques by calling +33 (0) 6 29 97 73 19, or by emailing infos@mahautbarbier-antiques.com

Upon receipt of the returned products, MAHAUT BARBIER ANTIQUES will send the customer replacement products, provided they are available. If necessary, MAHAUT BARBIER ANTIQUES will refund the customer in full.

We have a 30-day return policy, which means you have 30 days after receiving your item to request a return.

To be eligible for a return, your item must be in the same condition as when you received it, unworn or unused, with tags and in its original packaging. You will also need the receipt or proof of purchase.
